Tim McGuigan is a senior associate at Wynn Williams, where his specialty areas of practice are prosecution, regulatory enforcement and civil litigation. Since electing to study law at Victoria University of Wellington, he has been focused on building a successful career. By graduation, McGuigan had received awards in intellectual property and evidence, and finished his education intent on carving out a name as a litigator.
“My practice has focused on regulatory litigation, with particular emphasis on local government. I am an expert in assessing and developing regulatory performance, with a focus on understanding the specific needs and priorities of clients,” he explains.
Prior to joining Wynn Williams, McGuigan spent several years at the Auckland Crown Solicitor’s office. He considers that time as formative, where he was able to develop his advocacy skills by conducting jury trials and appellate work.
More recently, McGuigan is also proud to have been sole counsel in the High Court in Dewhirst v Canterbury Regional Council (2021) 22 ELRNZ 830. This case was the first to clarify the approach to determining costs awards under Section 6 of the Costs in Criminal Cases Act 1967. He was similarly lead counsel in the Court of Appeal in Trent v Canterbury Regional Council (2021) 22 ELRNZ 617, which was a second appeal against sentence, clarifying the sentencing approach between individuals and corporate entities under the Resource Management Act 1991.
Discussing his professional qualities, he says, “I am always open to different views and often find the best solution is reached by inviting contention and debate from colleagues. This allows issues to be identified early and rigorously tested to provide the client with the best service and advice.”
Part of his focus is building lasting relationships with clients. He manages this by offering training opportunities to clients in order to enhance the skillsets within their teams and by developing junior solicitors to ensure he can prioritise his time where it’s best served.
More recently, McGuigan’s practice has focused on providing advice on environmental compliance, monitoring and enforcement issues, as well as prosecution work on behalf of several local authorities. In addition, he is keen to assist less experienced colleagues and act as a mentor to them.
“I prefer to work collaboratively with clients, particularly local government clients and interested parties, to ensure a holistic approach is taken to problem-solving,” he says. “I’m also very conscious of the need to identify and nurture young legal talent in the workplace, to ensure that I am able to offer the same opportunities to learn that I received as a junior lawyer.”
